Somymy respects the intellectual property rights of others and expects all users of the platform to do the same. It is our policy to respond to clear and complete notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”) and applicable international intellectual property laws.
This DMCA Policy explains how copyright owners may submit a takedown request and how Somymy will handle such notifications.
1. Reporting Copyright Infringement (DMCA Takedown Request)
If you believe your intellectual property rights have been infringed, please notify us with a DMCA takedown request containing the following information:
- Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are affected.
- Identification of the material that is claimed to be infringing, including specific URLs or links to where the material appears on Somymy.
- A statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Your full legal name, address, email, and a physical or electronic signature.
DMCA notices should be sent to:
Email: contact@somymy.com
Subject: DMCA Takedown Request
Incomplete notices may not be processed.
2. Counter-Notification (If You Believe Content Was Removed in Error)
If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notification that includes:
- Identification of the material that has been removed or disabled.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, email address, and consent to the jurisdiction of the courts in your region.
- Your physical or electronic signature.
If a valid counter-notification is received, we may restore the content unless the original complainant initiates legal action within the time period required by law.
3. Repeat Infringer Policy
Somymy reserves the right to terminate, suspend, or otherwise restrict any account belonging to a user who is determined to be a repeat infringer or who repeatedly uploads content that violates this DMCA Policy.
4. Removal of Content Without Notice
Somymy may remove or disable access to any content on the platform without prior notice if it believes, in good faith, that the content may infringe intellectual property rights or violate applicable laws or platform rules.
